Probiotics and FDA Oversight: What You Need to Know

November 11, 20231 min read

In the world of dietary supplements, probiotics have gained significant attention for their potential health benefits. However, the regulatory landscape surrounding these products might surprise you.

The FDA doesn't subject probiotics to the same rigorous testing as pharmaceutical drugs. Why? Well, it's because probiotics are not classified as drugs. When a probiotic company plans to bring a new product to the market, they're required to submit a notice to the FDA. This notice includes a list of ingredients and safety information for the probiotic. Once this notice is sent, the manufacturer can start selling its supplements to the public after a waiting period of 90 days. It's important to note that this FDA oversight primarily focuses on ensuring the safety of these supplements, not necessarily their effectiveness. As a result, this more relaxed regulatory approach has allowed questionable products to flood the market.

Here's the catch: what's written on the label in terms of the number of live probiotics in the bottle may not always align with the actual contents. Furthermore, companies are not obligated to provide documentation proving the presence of specific bacteria in their supplements. This lack of accountability means that there's little motivation for these companies to explore and innovate with new probiotics.
